Elon Musk has sought the removal of Sam Altman and President Greg Brockman from OpenAI as part of an ongoing legal battle over the company’s transition to a for-profit structure, triggering a sharp response from the AI ​​firm.

The request is part of a broader case alleging the founders abandoned their founding mission, with a jury trial scheduled to begin later this month.

In a court filing, Musk stated that his lawsuit aims to “unwind OpenAI’s for-profit conversation and restructuring.” He argued that this would require changes in leadership, including the removal of key executives.
Responding to the move, OpenAI strongly criticized Musk, calling the lawsuit ‘baseless’ and accusing him of attempting to disrupt its operations. In a post on X, the company argued that Musk’s legal case is motivated by personal and financial interests rather than genuine concern for the organization.

The San Francisco-based tech company said, “Today, at the eleventh hour, Elon lodged a court filing pretending to change his tune about attacking the nonprofit OpenAI Foundation.”

According to the company, Musk’s actions are part of a broader attempt to gain influence and slow down competition in the rapidly evolving AI sector.

“The truth is that this case has always been about Elon generating more power and more money for what he wants. Having increasingly realized that his attempt to damage the nonprofit OpenAI Foundation rests on a baseless legal case, Elon is once again trying to change the narrative and save face as the trial approaches. His lawsuit remains nothing more than a harassment campaign that’s driven by ego, jealousy and a desire to slow down a competitor,” it said.

The dispute stems from Musk’s lawsuit against OpenAI and Microsoft, in which he alleged that the company had deviated from its founding principles after receiving significant investment and started planning restructuring.

In a fresh escalation, OpenAI has reportedly written to authorities in California and Delaware, seeking an investigation into what it described as “improper and anti-competitive behavior” by Musk and his associates. According to Jason Kwon, chief strategy officer at OpenAI, Musk had repeatedly attempted to gain control of its nonprofit structure and had failed.

According to a report in CNBC, Kwon alleged that the xAI CEO has been working to undermine the company with numerous ‘attacks’ on OpenAI, including “coordinating his efforts” with Meta CEO Mark Zuckerberg.

OpenAI also suggested that Musk’s actions could be linked to competitive interests, particularly benefiting his AI venture, xAI, and its Grok platform.

“These attacks are designed to take control of the future of AGI out of the hands of those who are legally obligated to pursue the mission of ensuring that AGI benefits all of humanity, and put it into the hands of competitors who lack mission-driven principles and spurn any responsibility for safety,” Kwon said.

The legal battle is set to intensify ahead of a scheduled trial on April 27, with both sides exchanging strong allegations.
